La relación existente entre el Estado y los ciudadanos remonta épocas antiguas, donde se le exigía la contribución para el pago de los gastos de la monarquía, con el desarrollo del hombre moderno nace la Relación Jurídica Tributaria, donde esta representa la personificación tanto de la potestad de imposición como del deber de contribución, mejor conocidos y aceptados como Sujeto Activo y Sujeto Pasivo, a través de las distintas acepciones, en tal sentido se analiza esta relación a la luz del (...) ordenamiento jurídico venezolano, enmarcada en una investigación de tipo documental, mediante la observación directa y aplicándola hermenéutica jurídica y teniendo como bases fundamentales la Constitución de la República Bolivariana de Venezuela (Asamblea Nacional Constituyente, 1999), Código Orgánico Tributario (Asamblea Nacional, 2001), jurisprudencia patria y de la doctrina tanto nacional como extranjera, se determinó en esta investigación la génesis de la Relación Jurídica Tributaria a través de los actores intervinientes, Sujeto activo, Sujeto Pasivo en sus distintas posiciones, contribuyente solidario, contribuyente Responsable, de igual forma la Relación Jurídica Tributaria desencuentra fundamentada en el hecho imponible, siendo esta la raíz de la tributación a cualquier nivel, bien sean impuestos, tasas o contribuciones. Igualmente la base imponible, significa representación monetaria del hecho imponible la cual será objeto de un tratamiento fiscal para una determinación de un tributo a pagar. (shrink)

El modelo constructivista, pedagogías innovadoras, didácticas colaborativas y dialógicas serían ensambladas desde la telemática, para validarlas como buenas prácticas, con el propósito de seguir formando alumnos que logren sus propios constructos cognitivos significativos (...) y sustentables, desde el reto perpetuo y hoy más vigente que nunca de desaprender, para reaprender. Despite the proliferation of research on ethical leadership, there remains a limited understanding of how specifically the assumingly moral component of this leadership style affects employee behavior. Taking an identity perspective, we integrate the ethical leadership literature with research on the dynamics of the moral self-concept to posit that ethical leadership will foster a sense of moral identity among employees, which then inspires followers to adopt more ethical actions, such as increased organization citizenship behavior. We further argue that these identity (...) effects should be more pronounced when leaders are perceived to be group prototypical, as their actions then speak louder to followers’ sense of identity. Two studies—a scenario experiment with 138 participants and a field study with 225 employees—provided support for our hypothesized moderated mediation model. Perceived ethical leadership positively affected OCB via followers’ moral identity but only under conditions of high perceived leader group prototypicality. We discuss how the identity pathway of ethical leadership can facilitate novel theorizing about moral transference. Our findings also suggest that, when hiring external ethical leaders or training internal managers, practitioners are well advised to consider that these individuals may only be effective in morally transforming followers when they are perceived as prototypical for the group. Los y las estudiantes denominados migrantes internos o interregionales, así como los jóvenes migrantes retornados o pertenecientes a la generación 1.5 enfrentan un cúmulo de adversidades que deben sortear durante sus trayectorias escolares en la universidad pública y en muchos de los casos no son visibilizadas ni atendidas por las IES. En el presente ensayo se pretende proveer algunas estrategias que puedan servir de punto de partida para la atención y seguimiento a estos grupos de población estudiantil.

The COVID-19 pandemic has impacted medical care in many ways; previously, a patient would enter a hospital and had an approximate idea of what would happen upon his admission, the physician informed them about it, but in the last two years this scenario has changed. Therefore, our aim was to identify if bioethical principles are present in the physician–patient relationship and the effect of these in the health care provided, through an observational and descriptive study where patients answered the validated (...) ReMePaB questionnaire that measures the presence of bioethical principles in the physician–patient relationship, on the seventh day of their hospital stay and 24 h after discharge, during the period from 1 August to 5 November 2020. In autonomy, an improvement in the score was observed in the second application compared to the first measurement; in the principle of non-vulnerability, the same scenario was observed for the first and second measurements, respectively. In the principles of beneficence, dignity, and justice, no statistically significant differences were observed. Considering the presence or absence of bioethical aspects in health care in this pandemic creates an area of opportunity to know the feelings of the patient during the care received and to maintain what is done well and improve those aspects that can be improved. En esta investigación se analiza el pensamiento de Frantz Fanon, un pensador crítico del sistema colonial -especialmente (Caribe y África)-, se trabajará algunos elementos que se encuentran en el colonialismo, a través de sus obras más importantes como: Piel Negra, máscaras blancas y Los condenados de la tierra. Del mismo modo, se abordará un problema de carácter neurálgico en el planteamiento del autor como lo es el prejuicio del color y la visión de los europeos en relación a la problemática (...) étnica. This essay begins with a Native American women's perspective on Early Feminism which came about as a result of Euroamerican patriarchy in U. S. society. It is followed by the myth of "tribalism," regarding the language and laws of U. S. colonialism imposed upon Native American peoples and their respective cultures. This colonialism is well documented in Federal Indian law and public policy by the U. S. government, which includes the state as well as federal level. The paper proceeds to (...) compare and contrast these Native American women's experiences with pre-patriarchal and pre-colonialist times, in what can be conceptualized as "indigenous kinship" in traditional communalism; today, these Native American societies are called "tribal nations" in contrast to the Supreme Court Marshall Decision which labeled them "domestic dependent nations." This history up to the present state of affairs as it affects Native American women is contextualized as "patriarchal colonialism" and biocolonialism in genome research of indigenous peoples, since these marginalized women have had to contend with both hegemonies resulting in a sexualized and racialized mindset. The conclusion makes a statement on Native American women and Indigensim, both in theory and practice, which includes a native Feminist Spirituality in a transnational movement in these globalizing times. The term Indigensim is conceptualized in a postcolonialist context, as well as a perspective on Ecofeminism to challenge what can be called a "trickle down patriarchy" that marks male dominance in tribal politics. A final statement calls for "Native Womanism" in the context of sacred kinship traditions that gave women respect and authority in matrilineal descendency and matrifocal decision making for traditional gender egalitarianism. Durante los últimos decenios, viene ganando terreno un modelo de uni-versidad basado en el management, en detrimento de la universidad humboldtiana, erigida sobre pilares humanísticos. Esta situación nos interpela con vehemencia: ¿qué lugar deberían ocupar las humanidades en las universidades actuales? El presente trabajo intentará contri-buir a este interrogante desde una perspectiva en particular, a saber: ¿qué puede aportar la enseñanza de la ética filosófica a estudiantes de carreras científicas y tecnológicas?

This book examines the human ability to participate in moments of joint feeling. It presents an answer to the question concerning the nature of our faculty to share in what might be called episodes of collective affective intentionality. The proposal develops the claim that our capacity to participate in such episodes is grounded in an ability central to our human condition: our capacity to care with one another about certain things. The author provides a phenomenologically adequate account of collective affective (...) intentionality that takes seriously the idea that feelings are at the core of our emotional relation to the world. He details a form of group emotional orientation that relies on the fact that the participating individuals have come to share a number of concerns. Readers will learn that at the heart of a collective affective intentional episode, one does not merely find a set of shared concerns, but also a particular mode of caring. In the end, the argument presented in this monograph makes plausible the idea that the emotions through which humans participate in moments of affective intentional community express our nature. In addition, it shows that the debate on collective affective intentionality also permits us to better understand the relationship between two conflicting philosophical pictures of ourselves: the idea that we are essentially social beings and the claim that we are creatures for whom our personal existence is an issue. Thus, aiming at an elucidation of the nature of our ability to feel together, the book offers a detailed account of what it is to situationally express our human nature by caring about something in a properly joint manner. The overturn of Roe v. Wade has resulted in fewer rights and resources for people seeking abortion care, particularly in the South. The Hyde Amendment has historically restricted abortion access for those enrolled in Medicaid. We argue here that its guarantees of minimum abortion coverage should be leveraged to offset harms where possible.

This article revises Foucault's account of biopolitics in the light of the impact of the molecular and digital revolutions on `the politics of life itself'. The confluence of the molecular and digital revolutions informationalizes life, providing an account of what it is to be a living thing in terms of complex adaptive and continuously emergent, informationally constituted, systems. Also revisiting Foucault's The Order of Things and its interrogation of the modern analytics of finitude, the article argues that our contemporary politics (...) of life is therefore distinguished by the quasi-transcendentals that now distinguish informationalized life: circulation, connectivity and complexity. Here, too, the article argues, the figure of Man, which once united the quasi-transcendentals of life, labour and language, is replaced by the contingency that now unites circulation, connectivity and complexity. Observing that a life of continuous emergence is also one in which production is continuously allied with destruction, such a life is lived as the continuous emergency of its own emergence. This account of contemporary biopolitics, together with its emergency of emergence, contrasts, in particular, with that offered by Agamben in his appropriation of Schmitt. (shrink)

O objetivo do presente artigo é expor a leitura que a psicanálise lacaniana levanta acerca das causas que levam à irrupção da agressividade, principalmente em razão do caráter frequente deste fenômeno em educação. Sendo o método utilizado basicamente o dissertativo, procurou-se ressaltar a dimensão filosófica do problema. O próprio Lacan se apropria do legado hegeliano e marxista para desdobrar a tese da agressividade enquanto realização de uma dinâmica instaurada a partir do olhar e que tem o seu modus operandi nos (...) movimentos de alienação e de desalienação. A agressividade, ilustrada, por exemplo, pelas injúrias sofridas pelos professores mostra-se como tentativa de provocar a queda do Outro, queda essa tida como objeto a cujo modo de aparição é regulado pelo complexo de Édipo. Isto é, tanto o modo como se inscrevem as figuras de autoridade parentais nas cadeias significantes de que é composto o sujeito quanto o modo como essa inscrição molda as possibilidades existenciais de articulação com o sexo oposto seriam chave para antevermos em que medida o sujeito faz uso da agressividade. Nessa medida, o complexo de Édipo, reinvestido pelo acontecimento da puberdade, seria responsável pelo deslocamento da libido ora para o Outro ora para o próprio sujeito. O Outro, no desdobramento teórico de Lacan que se segue à década de 60, compreende tanto as escolhas identificatórias quanto aquilo que escapa a qualquer identificação. O Outro, por exemplo, na figura do professor, tem tanto o papel de se posicionar enquanto tal e assim gerar intuitivamente um processo de identificação, quanto o delicado papel de sustentar a dialética que surge no momento em que o Outro cai, momento esse que frequentemente se segue à identificação e que acontece junto a um gozo capaz de desvelar o objeto a. Muito embora o papel em educação não seja manter uma ausculta a esse objeto, a educação pode fazer com que esse objeto não seja excluído e seja contornado junto ao advento de singularidades. Neste momento, a explicitação das regras através das quais a educação se constitui assim como a empatia do educador aparecem como instrumentos fundamentais na educação tanto quanto a própria matéria a ser ensinada. Do texto, depreendemos a seguinte conclusão: acerca da necessidade de causarmos a colocação da agressividade na fala como via de conquista do processo de desalienação conjugada com uma possibilidade de sustentação do desejo. Abstract:There is debate about the ontological status of conventional entities in Abhidharma thought. Buddhist texts often draw a distinction between two different kinds of entities, ultimately real entities (paramārtha-sat) and conventionally real entities (saṃvṛti-sat), but are often unclear about what the distinction entails. The debate about whether past and future dharmas are ultimately real reveals that Sam.ghabhadra and Vasubandhu—two prominent Abhidharma philosophers—fundamentally disagree about whether reality consists in one or many modes of being. Saṃghabhadra's Sarvāstivāda position is best understood as (...) the ontologically pluralist view that a dharma can enjoy three distinct but equally fundamental temporal modes of being. Vasubandhu's position is that reality is univocal, that everything is real in the same sense. Because Saṃghabhadra is a pluralist and Vasubandhu is not, Saṃghabhadra affirms the reality of conventional entities whereas Vasubandhu does not. (shrink)

This paper takes on several distinct but related tasks. First, I present and discuss what I will call the “Ignorance Thesis,” which states that whenever an agent acts from ignorance, whether factual or moral, she is culpable for the act only if she is culpable for the ignorance from which she acts. Second, I offer a counterexample to the Ignorance Thesis, an example that applies most directly to the part I call the “Moral Ignorance Thesis.” Third, I argue for a (...) principle—Don’t Know, Don’t Kill—that supports the view that the purported counterexample actually is a counterexample. Finally, I suggest that my arguments in this direction can supply a novel sort of argument against many instances of killing and eating certain sorts of animals. (shrink)
